Terms & conditions

These terms and conditions apply when you use this website or buy from McLeod Pearls of Manihiki online. Please read them before placing an order. By placing an order, you agree to these terms.

1. About us

This website is run by McLeod Enterprises Ltd, trading as McLeod Pearls of Manihiki, a family business based in Rarotonga, Cook Islands. Our shop is in Maraerenga, Tupapa, in front of Cook Islands News. Email us at mcleodpearls777@gmail.com.

2. Our products

We sell genuine Cook Islands cultured black pearls and pearl jewellery. Pearls are natural, so each one varies in colour, overtone, shape, size and surface. We describe and photograph every piece as accurately as we can, but the item you receive may differ slightly from the photos, and colours can look different on different screens. Measurements and weights are approximate.

Many of our pieces are one of a kind. If an item sells in the shop before your online order is processed, we’ll let you know and give you a full refund or offer you a similar piece.

3. Prices and payment

All prices are in New Zealand dollars (NZD) and include any taxes that apply in the Cook Islands. Shipping costs are shown separately at checkout. We may change prices at any time, but the price you pay is the one shown when you place your order.

We accept Visa and Mastercard. Payments are processed securely by the Bank of the Cook Islands (BCI). You enter your card details on BCI’s secure payment page, and we never see or store your full card number. If your bank converts the payment to your own currency, it may charge a fee or use its own exchange rate.

If an item is listed at the wrong price because of an error, we’ll contact you before sending it and you can choose to pay the correct price or cancel the order for a full refund.

4. Orders

After you order, we’ll email you an order confirmation. This confirms we’ve received your order, but it isn’t an acceptance. A contract between us is formed when we send or prepare your item for collection. We may decline or cancel an order, for example if an item is unavailable or we suspect fraud. If we do, we’ll refund anything you’ve paid in full.

5. Shipping and collection

Shipping, delivery times, click and collect, and customs charges are covered in our Shipping and delivery policy, which forms part of these terms. Responsibility for an item passes to you once it has been delivered to your address or collected.

6. Returns and refunds

Our Returns and refunds policy explains how to return an item and when you can get a refund. It forms part of these terms.

7. Your consumer rights

Nothing in these terms limits any rights you have under the consumer laws of the Cook Islands or the country you live in that can’t be excluded by agreement.

8. Our liability

To the extent the law allows, we’re not liable for any indirect or consequential loss arising from your use of this website or your purchase, and our total liability for any order is limited to the amount you paid for it.

9. Your account and privacy

If you create an account, please keep your login details safe. We collect only the personal information we need to process and deliver your order and to contact you about it. We don’t sell your information, and we share it only with the people who need it to complete your order, such as our payment provider and courier. If you sign up to our emails, you can unsubscribe at any time. To see or correct the information we hold about you, contact us.

10. Website content

All photos, text and designs on this website belong to McLeod Pearls of Manihiki or are used with permission. Please don’t copy or use them without our written permission. We try to keep the website accurate and available, but we can’t promise it will always be error free or uninterrupted.

11. Changes to these terms

We may update these terms from time to time. The version on the website when you place your order applies to that order.

12. Governing law

These terms are governed by the laws of the Cook Islands, and any dispute will be dealt with by the courts of the Cook Islands.
